You are solely responsible for safeguarding your password and for restricting access to your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

Gradeswiftly provides AI-powered analysis of graded trading cards, including market pricing, listing title and description generation, and marketplace integration services.

Our pricing is based on a per-card model, as detailed on our Pricing page. We reserve the right to change our pricing at any time, with or without notice.

While we strive for accuracy in our card analysis and pricing information, we cannot guarantee 100% accuracy. Market conditions fluctuate, and our analysis should be used as a guide rather than definitive valuation.

Payment for our services is required before card analysis is performed. All payments are processed securely through our payment processors.

All fees are non-refundable except in cases where the Service fails to provide any analysis results. In such cases, you may request a refund within 7 days of the failed analysis.

We may offer promotional pricing or discounts at our discretion. Such promotions may be limited by time, user count, or other factors as specified in the promotion details.

When you upload card images or other content to our Service, you grant Gradeswiftly a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content solely for the purpose of providing and improving the Service.

You represent and warrant that you own or have the necessary rights to the content you upload, and that such content does not violate the rights of any third party.

We may use anonymized data derived from user content to improve our algorithms and services. This data will not contain personally identifiable information.

The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of Gradeswiftly and its licensors.

Our trademarks, service marks, logos, and trade names may not be used without our prior written consent.

The analysis results, including pricing information, listing titles, and descriptions generated by our Service, may be used by you for personal or commercial purposes related to selling your cards.

Our Privacy Policy, available at gradeswiftly.com/privacy, describes how we collect, use, and share your personal information. By using our Service, you agree to the collection and use of information in accordance with our Privacy Policy.

We implement appropriate technical and organizational measures to protect your personal data against unauthorized or unlawful processing, accidental loss, destruction, or damage.

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. GRADESWIFTLY AND ITS SUPPLIERS AND LICENSORS HEREBY DISCLAIM ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

NEITHER GRADESWIFTLY NOR ITS SUPPLIERS AND LICENSORS MAKES ANY WARRANTY THAT THE SERVICE WILL BE ERROR FREE OR THAT ACCESS THERETO WILL BE CONTINUOUS OR UNINTERRUPTED, OR THAT THE SERVICE OR ITS CONTENT WILL MEET YOUR REQUIREMENTS.

GRADESWIFTLY DOES NOT GUARANTEE THE ACCURACY OF CARD PRICING OR ANALYSIS RESULTS. MARKET CONDITIONS FLUCTUATE, AND OUR ANALYSIS SHOULD BE USED AS A GUIDE RATHER THAN DEFINITIVE VALUATION.

IN NO EVENT SHALL GRADESWIFTLY, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT; (II) PERSONAL INJURY OR PROPERTY DAMAGE OF ANY NATURE WHATSOEVER RESULTING FROM YOUR ACCESS TO AND USE OF OUR SERVICE; (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION STORED THEREIN.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID TO GRADESWIFTLY IN THE LAST SIX (6) MONTHS, OR, IF GREATER, ONE HUNDRED DOLLARS ($100).

You agree to defend, indemnify, and hold harmless Gradeswiftly, its officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Service; (ii) your violation of any term of these Terms; (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your content caused damage to a third party.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
